SIMPLIFLY product, which includes SIMPLIFLY SIM card and the services it provides, this website and Mobile App SIMPLIFLY, are provided by China Mobile Hong Kong Company Limited (hereafter: "CMHK" or "we",). This Terms & Conditions (hereafter: “Terms”) apply to all customers (hereafter: “the customer" or “you”). Please read these Terms carefully before you access or use this website or Mobile App.

 

1. Agreement

1.1 By selecting the service of SIMPLIFLY, you are agreeing to be bound by this Terms, CMHK Privacy Policy Statement and any other terms and conditions displayed on any SIMPLIFLY websites or mobile app.

1.2 In the event of any discrepancy between the English and Chinese versions of the above terms and conditions, the Chinese version shall prevail.

 

2. SIMPLIFLY Products and Services

2.1 Once SIMPLIFLY SIM card is distributed or sold, the SIM card and the stored value it contains cannot be returned or exchanged as cash. They can not be replaced, refunded, transferred or resold. SIMPLIFLY will not be liable for any damages, however arising, of the SIM card or responsible for repairing and making good therefore.

2.2 The mobile phone number of SIMPLIFLY is assigned randomly and cannot be chosen, returned or requested to change to other mobile numbers. You will not be able to keep the allocated mobile number once this SIM Card has expired or terminated due to whatever reasons. The remaining amount and package (if any) in your SIMPLIFLY account also cannot be returned, refunded or transferred.

2.3 The SIM must be activated on or before the last activation date as stipulated in SIMPLIFLY website/apps or on the SIM card, or it will be invalid to use afterwards (please refer to the product packing for details of the activation steps). Upon activation, the expiry date of the SIM Card is 180 days starting from the date of activation (if the SIM card is purchased from SIMPLIFLY website or app, the expiry date of the SIM Card is 180 days starting from the date of purchased). Any usage behavior including refilled SIMPLIFLY SIM card, purchased local data package, purchased local voice package, purchased travel data package are eligible to extend the SIM card validity 180 days automatically. If above usage behaviour does not happen during the period of SIM card validity, SIMPLIFLY service will be terminated automatically without notice.

2.4 All service charges of SIMPLIFLY SIM card, including but not limited to roaming data packages, local packages, local voice and and SMS and other services, are deducted from the stored value of SIMPLIFLY SIM card. To increase the stored value, you may log in SIMPLIFLY website or apps to refill for the SIM card.

2.5 SIMPLIFLY provides roaming data service only in areas outside Hong Kong, but not voice, SMS and other services.

2.6 If SIMPLIFLY SIM card is lost, all lost value will not be returned or refunded.

2.7 Calculation of call airtime is based on the network report of SIMPLIFLY. In case of dispute, the statement of SIMPLIFLY is conclusive and binding. All calculations are subject to such prevailing rates or tariff as SIMPLIFLY shall from time to time impose.

2.8 SIMPLIFLY is entitled at their full discretion to temporarily suspend any or all of the Services without notice to the Customer for the purpose of preventing any improper or abnormal use of SIMPLIFLY's network or resources, fraudulent or deceptive acts until SIMPLIFLY is satisfied that the Customer has ceased such acts or the relevant investigation has been completed. SIMPLIFLY may assess abnormal usage based on comparisons to the usage patterns and levels of SIMPLIFLY's other customers, and/or based on whether such usage level is considered to have affected our other customers' ability to optimally use the same network or service.

2.9 SIMPLIFLY reserves its absolute right to change the terms and conditions relating to the use of the SIM card including but not limited to the airtime or SMS tariffs or rates at any time without prior notice to or consent from the Customer.

2.10 The above information and rates are subject to change without prior notice.

2.11 Any change or amendment will be published on SIMPLIFLY Website.

3. Tavel Data Package

3.1 Travel data package must be subscribed via SIMPLIFLY website or apps. All subscribed travel data package will be activated automatically when inserting the SIM in the handset upon arriving the above mentioned area within 14 days before or within 30 days upon the selected start date (Hong Kong time) (i.e. effective activation period). If the service of the package cannot be activated during the above mentioned effective activation period, it will be invalid and you are not entitled to request any form of compensation.

3.2 The 24-hour/48-hour travel data package starts when the customers activate the service and it can be used for consecutive 24 hours / 48 hours.

3.3 For travel data packages other than the 24-hour/48-hour packages, the valid period is from Hong Kong time (GMT+8) 00:00:00 to 23:59:59. Actual usage less than 1 day will be charged on full day basis.

3.4 Travel data package works on mobile phones, tablets and iPads (except the WiFi model). The actual service performance and data transmission speed may vary due to many factors, including but not limited to, the network traffic, model of the handset/device, setting (including device hardware and software), upload/download content and other external factors.

3.5 Travel data package supports the data tethering function, but not peer-to-peer applications (P2P), FTP file sharing and webcam applications.

3.6 SIMPLIFLY provides roaming data services in designated networks of operators. Please refer to SIMPLIFLY website and apps for the details. The number and coverage of network are subject to change and update without any prior written notice.

3.7 The availability of SIMPLIFLY services while roaming aboard depends on the network of overseas roaming partner, the transmission of the customers’ device and the actual location of the customers. Customer use SIMPLIFLY service outside of Hong Kong may subject to the laws and regulations of the country in which they visit. Customers must comply with these laws and regulations; SIMPLIFLY is not be responsible and liability if the customer fails to comply with relevant laws and regulations. 

3.8 The cellular device might automatically capture the roaming signals of network operators used by overseas roaming partners outside the “SIMPLIFLY” coverage and incur extra roaming charges under extreme circumstances. SIMPLIFLY accepts no liability on such circumstances. In case of dispute, the records of SIMPLIFLY and overseas roaming partner shall prevail.

3.9 Roaming data services are subject to Fair Usage Policy (FUP) if applicable. When roaming data usage consumed between 00:00 to 23:59 (Hong Kong Time) reaches specific fair usage, the customers still can enjoy the roaming data services. However, data access speed (uploading and downloading) will be maintained at 256kbps/ 128kbps. Specific fair usage will be mentioned when the customers purchase travel data package. Upon excessive usage of roaming data, local data & local voice, these services will be automatically terminated, you are required to re-purchase.

3.10 The availability and coverage of the network vary depending on customer’s location. The quality of the services depends in whole or in part on your mobile phone and mobile device, the network and other factors. The services might be adversely affected if too many people try to use the network at the same time; by physical features (such as buildings etc); and by atmospheric conditions or other causes of interference.

3.11 The use of designated handset model(s) or device(s) are required for using 4G network service. Actual network service will be subject to and affected by the network coverage, system compatibility and other factors

 

4. Local Packages and Other Usage

4.1 Local packages can be subscribed via SIMPLIFLY website or apps, or you may also use the services directly and charged by your usage. The validity period of local package is same as the validity period of your SIMPLIFLY SIM card.

4.2 In those Hong Kong areas where the 4G networks are not available, CMHK will provide the service under 3G/2G EDGE. Actual network service will be subject to and affected by the network operator, network usage, designated handset model(s), settings (hardware and software), upload/download content sizing, and other factors.

4.3 Tethering, P2P applications (incl. BitTorrent) will not be supported in Hong Kong while using local data service.

4.4 SIMPLIFLY cannot be used for calls to Infoline Call numbers with "900" prefix.

4.5 When the cumulated local voice used up during the validity period, thereafter local voice will be charged on a pay-as-you-go basis.

4.6 Calculation of call airtime is based on the network report of SIMPLIFLY. In case of dispute, the statement of SIMPLIFLY is conclusive and binding. All calculations are subject to such prevailing rates or tariff as SIMPLIFLY shall from time to time impose.

4.7 SIMPLIFLY only support calling number display, missed call alert, call forward package , voice & fax mailbox, call waiting & call hold, conference call.

4.8 When using the Call Waiting and Call Hold feature, subscribers need to pay the airtime charge for the first answered call, as well as the other calls answered or on hold at the same time.

4.9 When using the Conference Call feature, subscribers need to pay the airtime charge for all connected lines at the same time.

4.10 Please check if applicable handset models are used to receive the SMS content, and if the recipient's network is compatible. Otherwise customer could be charged even if the transmission is unsuccessful.

4.11 Receiving and sending multimedia messages requires data usage which is deducted in local data package.

 

5. Product Delivery

5.1 SIMPLIFLY new purchase orders will be dispatched via local flat mail service within 7-10 working days, not applicable to the delivery of Post Office Boxes. Any unsuccessful delivery of SIMPLIFLY due to delivery loss, delay, damage or stolen under any circumstances beyond the control of SIMLLIFLY and/or any omission, discrepancy or incorrectness of personal information provided by the customer, SIMPLIFLY will not assume any liability arising therefrom or in connection therewith. Customers are not entitled to request any form of compensation.
